Use of Account Policy

Customer (“you / your”) use of a TAB Account (“Customer / TAB Account”)

1. Customer Accounts will be created using your full name and surname. You further acknowledge and agree that in relation to your Customer Account:
   1.1 Third parties are not permitted to transact on the account on your behalf.
   1.2 It is your responsibility to protect your login credentials and passwords.
   1.3 Racing will deem any transactions concluded on your TAB Account to be yours.
   1.4 Accordingly, you accept all transactions that occur on your TAB Account to be your own.
   1.5 In the event of a dispute regarding the aforegoing, the onus to prove otherwise will rest on you.
2. You shall be responsible for the safekeeping and proper use of all your account details and other information that will enable you to place a bet. Furthermore, you undertake that you will:
   2.1 Not apply for or hold more than one account with 4Racing;
   2.2 Not apply for or hold an account in the name of or on behalf of any other person; and
   2.3 Not permit or enable any other person to place a bet, directly or indirectly, using the TAB’s account reference number or personal identification number issued to you by 4Racing from time to time.
3. TAB will not honour any transaction concluded in the manner described in clause 2 or pay out any winnings in respect of any bet placed in relation to such account. You will be responsible for any claims, losses or damages incurred by 4Racing arising out of the use of an account contrary to this clause 3.
4. You undertake to notify TAB immediately if your account information is lost, stolen, misappropriated, or utilised by someone other than yourself or you have reason to believe that any of these circumstances have occurred. Furthermore, and notwithstanding the aforementioned, you will remain responsible for all bets placed with TAB and any payments made by/to TAB in respect of any purchase and/or transaction concluded on your account up to and including your notifying TAB that any of the aforementioned circumstances had/have occurred.
5. TAB reserves the right to void any bets found to have been placed by a single customer using multiple accounts.
6. TAB reserves the right to use reasonable steps to independently determine the veracity of any information furnished to it by you.
   6.1 In instances where any of the information used for registration which cannot be verified or which differs materially from the proof you submit or which differs materially from 4Racing’s own verifications, 4Racing reserves the right to suspend or terminate your Customer Account.
   6.2 In such instances, your TAB Account will not be accessible and 4Racing shall not accept any liability arising out of such action taken by it in this regard.
7. 4Racing reserves the right to suspend or terminate your TAB Account if you fail to furnish any mandatory information or where the necessary processes have not been followed, or for any other reason that would render the TAB Account non-compliant with regulatory requirements.
8. You warrant that all information provided in the TAB Account application form completed by you is and will remain true and correct.
9. 4Racing will rely on this information. If any information provided by you is found to be incorrect or untrue, you will be liable to pay for any damages suffered by 4Racing.
10. TO THE FULLEST EXTENT PERMISSIBLE UNDER ALL APPLICABLE LAW, YOU HEREBY INDEMNIFY AND HOLD 4RACING, ITS EMPLOYEES AND AGENTS, AND ANY ENTITY WHICH IS PART OF 4RACING, HARMLESS AGAINST ANY LIABILITY, DAMAGES AND/OR LEGAL ACTION WHATSOEVER AND HOWSOEVER ARISING, INCLUDING NEGLIGENCE ON THE PART OF 4RACING, ITS EMPLOYEES OR AGENTS AND 4RACING SHALL NOT ACCEPT LIABILITY FOR ANY DAMAGES OR ANY TYPE OF LOSS SUFFERED BY CUSTOMERS WHO TRANSACT WITH 4RACING AND MAKE USE OF 4RACING’S WEBSITE/S OR THROUGH ANY ACT OF WRONGDOING OR NEGLIGENCE BY 4RACING OR THE
    AFOREGOING PERSONS EVEN BEYOND OF THE USE OF THE WEBSITE.
11. The transmission of information via the internet, including without limitation, electronic mail (“email”), is susceptible to monitoring and interception. Therefore, YOU AGREE AND ACKNOWLEDGE THAT YOU BEAR ALL RISK WHEN TRANSMITTING INFORMATION IN THIS MANNER. Under no circumstances shall 4Racing be liable for any loss, harm or damage suffered by the user as a result thereof. 4Racing reserves the right to request independent verification of any information transmitted via email and you hereby consent to such verification should 4Racing deem it necessary.
12. The following are the Terms and Conditions for fixed odds bets offered on TAB.co.za:
    12.1 4Racing is licensed to carry on business as a bookmaker by the Gauteng Gambling Board
    12.2 4Racing carries on business in accordance therewith as well as the prescribed Operational Rules for Bookmakers within South Africa.
    12.3 All game rules are available on each individual game offered by the relevant platform provider.
    12.4 4Racing complies with all gambling and betting laws to assure uniformity, transparency, fairness and protection in all your betting transactions. 
    12.5 Licensing:
    12.5.1 4Racing is a licensed bookmaker by the Gauteng Gambling Board under the license JOH-116
    12.5.1.1 The licensed contingencies are:

    Elbet - Fast Balls, Gold Mines and Rocketman
    12.5.2 Facilitated Contingency:
    12.5.2.1 A facilitated contingency bet refers to all bets taken on www.tab.co.za as a licensed bookmaker within the Republic of South Africa, that are based on the contingency offered and facilitated by MP Gaming (PTY) Ltd, a licensed bookmaker, licensed with Mpumalanga Economic Regulator (the "MER").
    12.5.2.2 The terms and conditions relating to facilitated bet contingencies are as follows:
    12.5.2.1 Facilitated bet contingencies are contingencies that are offered by MP Gaming (Pty) Ltd on websites and mobile platforms, which are approved and regulated by the MER as the relevant authority, which are accessed by the customer on the platforms of www.tab.co.za as the facilitated bookmaker in compliance with such regulator’s approval.
    12.5.2.2 The following facilitated bet contingencies offered and facilitated by MP Gaming (Pty) Ltd with license number 9-2-1-09553 are approved and regulated by the MER.

    12.5.2.3 The facilitated bet contingency transaction will be assigned to the province of Mpumalanga, where the facilitated bet contingencies are approved by the MER as the respective regulator. 
    12.5.2.4 TAB.co.za remains responsible for all FICA, Financial and Responsible Gambling operations in relation to the customer. 
    12.5.2.5 Any customer complaint pertaining to the listed facilitated bet contingencies will be handled by MP Gaming (Pty) Ltd 9-2-1-09553, in consultation with TAB.co.za
    12.5.2.6 MP Gaming (Pty) undertakes the responsibility of recording the facilitated bet contingencies in compliance with the MER’s approval.
    12.6 The rules and regulations of the Gauteng Gambling Board can be viewed at www.ggb.org.za The rules and regulations of the Mpumalanga Economic Regulator can be viewed and read at www.mer.org.za.
    12.7 Maximum Payouts:
